Ms Elizabeth's Journal, 03 May 2019

Does life ever get easier? Just when everything is in the up swing life decided to smack me upside the head. I have lived in Upstate NY for 9 years now. I have been trying to sell my old house in Illinois for 8 of those years. First the market tanked and then the market didn't rebound enough for me to get what I owed out of it. I finally had someone ask to do a deed agreement on it last year. They were supposed to get financing and pay me off on May 1st. Think that happened? Nope.

Not only did it not happen. It's gotten worse. Much much worse. They were supposed to maintain the property. They didn't. Apparently the home developed a leak in the ceiling at some point during that year and they didn't fix it. Now the roof needs to be completely replaced, the ceilings and floors in 4 of the rooms are damaged and there may be mold. She thought she could turn all of this over to insurance and they would pay out the total of the policy. The woman is insane. She even hired a lawyer to sue either me or the insurance agency. She says the insurance agency but I'm not putting it past her to sue me too.

What should have been a small enough check to buy me some breathing room in my checking account for furniture in the new house has now turned into a nightmare. I have a phone call with a new lawyer on Monday to go over my options. They are already in default of deed so I can evict them but I have no idea what that means for the teeny tiny bit of the roof that insurance is willing to fix. He said there is probably a little over $10,000 worth of damages and the insurance wouldn't be covering anywhere near that amount. Plus the insurance was put in the people who were supposed to be purchasing the property so I don't even know what that means. I'm not really looking for advice. I expect the lawyer to cover all of that on Monday. I just needed to vent and complain. I've only told a handful of people because everyone is so excited about the new house that I just bought.

I just don't know how I'm going to afford my house and repair a house in another state. I was really really hoping to have that thing off my hands. I was hoping to finally have a nice calm stress free life for a little while. Instead I'm playing around with the idea of finding freelance writing jobs or technical writing jobs or transcriptionist jobs just to maybe scrape together enough money to pay for a new roof on a home I wish would be hit by lightening right about now.

Being a grown up sucks.

I’m sorry to hear all that. I’m from Upstate Ny. West Lauren’s. Between Oneonta and Morris. I was born at Fox Hospital and sadly watched my father pass away there in 2014. Upstate NY is beautiful.

Hard to even imagine not being able to sell a house for that long. California here, where people are in bidding wars and paying as much as 30-40,000$ over asking price. Definitely in a mess good luck at the lawyer.

My brother is having the exact same experience with a property! (He could have written this, except that it's all happening in NYS.) Terribly stressful!

Nodding - no advice, just empathy. Cutty left me with several rental properties. I sold all but one (and that's because his daughter lives in it). Tenants NEVER take care of property like an owner would. They just don't care. See, no advice. I'm sorry.

Sorry about that - but now I remember I have to upgrade my rental insurance, so you have done some good sharing!

I hate to say it, but as someone employed in the insurance industry for the last five years, unless there's a MAJOR loophole she can find, I can almost guarantee the claim will be denied because most homeowners policies have clauses about reporting in a timely manner, and if the leak was there long enough for mold to form, it's probably been a minute since the leak started. However, I'm not sure how she'd justify suing you, especially if the upkeep was her responsibility. Feel free to PM me if you have any questions about the homeowners/renters insurance piece, I'll be happy to help however I can. <3

No advice, but lots of support and well wishes. Take it one day at a time, and do what you can as you can do it. I hope it gets better and everything works out in the end.
